1. Agreement to Terms

By installing and using Shopify Pagespeed Optimizer ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Service. We may update these Terms at any time, and your continued use of the Service constitutes acceptance of those changes.

2. Eligibility

You represent and warrant that:

You are at least 18 years old or the legal age in your jurisdiction

You are the owner or authorized manager of the Shopify store you're connecting
You will comply with all applicable laws and regulations

3. Service Description

Shopify Pagespeed Optimizer provides:

Performance audits of your Shopify store using Google Lighthouse
AI-powered recommendations for performance optimization
Dashboard to view audit results and recommendations
Core Web Vitals monitoring and tracking

The Service is provided "as is" and may be modified, suspended, or discontinued at any time. We will provide notice before discontinuing the Service.

4. User Responsibilities

You agree to:

Use the Service only for lawful purposes and in compliance with these Terms
Not interfere with or disrupt the Service or its servers
Not attempt to gain unauthorized access to the Service
Maintain the confidentiality of your Shopify access token
Immediately notify us of any unauthorized use of your account
Not reverse-engineer or decompile any Service technology
Not use the Service to compete with or damage our business

5. Intellectual Property Rights

Warranties that the Service will be uninterrupted or error-free
Warranties regarding the accuracy or completeness of recommendations

Recommendations are provided for informational purposes only and should not be considered professional advice. Always test changes in a development environment first.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

We are not liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability is limited to the amount you paid for the Service (or $0 if you use the free version)
This applies even if we have been advised of the possibility of such damages

8. Indemnification

9. Account & Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Disconnecting from the Service when finished
Notifying us immediately of unauthorized access

We are not responsible for unauthorized access to your account if you fail to maintain security.

10. Third-Party Services

The Service integrates with third-party services including:

Shopify - Your store and OAuth authentication
Google Lighthouse - Performance audits
Anthropic Claude - AI recommendations

You agree to comply with the terms of service of these third-party services. We are not responsible for their conduct, performance, or policies.

11. Data & Performance

Audit Accuracy: Lighthouse audits may vary based on timing, connection speed, and other factors. We are not liable for inaccurate or inconsistent results.

Recommendations: AI-generated recommendations are intended to provide guidance. Implementation is at your own risk. Always test changes in a development environment first.

Data Accuracy: We make reasonable efforts to maintain accurate data but do not guarantee completeness or accuracy of all information.

12. Service Availability

While we strive to maintain service availability, we do not guarantee:

Uninterrupted access to the Service
Error-free operation
Any specific uptime percentage

The Service may be unavailable due to maintenance, updates, or unforeseen circumstances. We will provide notice when possible.

13. Termination

By You: You may discontinue the Service at any time by uninstalling the app and disconnecting your store.

By Us: We may terminate or suspend your access if you violate these Terms or engage in abusive behavior.

Effect: Upon termination, your right to use the Service ends. Data retention follows our Privacy Policy.

14. Fees & Payment

Shopify Pagespeed Optimizer is currently free. If we introduce paid features in the future, we will:

Clearly display pricing before charging
Use Shopify's Billing API for all charges
Provide an easy upgrade/downgrade experience
Honor free tier access as promised

15. Prohibited Uses

You agree not to use the Service for:

Any illegal or harmful purpose
Hacking, circumventing security, or unauthorized access
Spreading malware or viruses
Harassing, threatening, or defaming others
Impersonating others or false representation
Competitive analysis that violates our interests
Bulk data collection or scraping
Any purpose that harms the Service or its users

16. Modifications to Terms

We may update these Terms at any time. Significant changes will be communicated to you. Your continued use of the Service after changes constitutes acceptance. If you do not agree with changes, you must discontinue the Service.

17. Governing Law

These Terms are governed by the laws of the United States, without regard to conflicts of law principles. You consent to jurisdiction in the courts of the United States.

If legal action becomes necessary, you agree to resolve disputes through binding arbitration rather than court proceedings, except for injunctive relief to prevent misuse of the Service.
